If you’re in this spot: you own several small rentals, maybe inherited, and you’d rather have one easier property than sell them all and pay tax.

How it works
You trade properties directly with another owner, using cash or a note to even out the values.
Key rules
- Can qualify as a 1031. A direct swap of investment real estate can qualify as a 1031 exchange, often without the 45/180-day wait.
- Evening-up money is taxed. Cash or debt relief you receive to even out values (“boot”) is taxable.
- Homes don’t count. Trading your personal home is a sale, though the home-sale exclusion may help.
California notes
Each deed is a change in ownership, so both properties are reassessed, and transfer taxes (including Measure ULA in the City of LA) apply to each deed. Form 593 covers exchange withholding. Out-of-state trades require FTB Form 3840.
Common mistakes
- Trading property not held for investment
- Ignoring boot
- Skipping title insurance on what you receive
Example (hypothetical)
Three rentals worth $1,200,000 total, with $600,000 of combined gain, are traded for one $1,200,000 building. If structured as a qualifying exchange, no current tax is due.

“I’m Erwin Miciano. I started SoCal Property Resolution because the families I met weren’t looking for a flashy cash offer. They were stuck: a house split between relatives, a probate case that wouldn’t move, a tax bill nobody knew about. My job is to explain your options honestly. Sometimes that means buying, and sometimes it means pointing you somewhere else.”
Frequently asked questions
Is a property swap taxable in California?
A direct swap of investment real estate can qualify as a 1031 exchange, but any cash or debt relief you receive to even out values is taxable.
Will my property taxes go up after a trade?
Usually. Each deed is a change in ownership, so both properties are reassessed.
Can I trade my own home?
Trading your personal home is treated as a sale, though the home-sale exclusion may help.
